On this day comes before me, a Notary Public acting in and for the County and State aforesaid, Mark E. Ford, to me
well known, who being first duly sworn, says, upon oath, the following:
1. That my name is Mark E. Ford, age 27, and I am a citizen and resident of Fort Smith, Arkansas. That I am a duly
licensed attorney at law within the State of Arkansas and have been so licensed since August 28, 1985.
2. That I represented Rolf Kaestel in a Habeas Corpus proceeding before the United States District Court for the
Western District of Arkansas, having case No. 86-2096. That two issues brought up in that case, namely the jurors’
lack of knowledge concerning Mr. Kaestel’s ineligibility for parole, or if given a life sentence, and the unique
harshness of his sentence, are pertinent, in my opinion, to any determination of executive clemency for Mr. Kaestel.
3. That in my capacity as Mr. Kaestel’s attorney in the above-mentioned habeas proceeding, I was able to contact
five of the twelve jurors which heard Mr. Kaestel’s case in State Court. At the time I made these juror contacts, I
was interested in obtaining information concerning each juror’s knowledge, or lack thereof, concerning Mr. Kaestel’s
ineligibility for parole if given a life sentence; and, if knowledge of such ineligibility would have affected in any way
their decision to impose a life sentence upon Mr. Kaestel. Four of the five jurors that I was able to contact did not
know at the time they imposed the life sentence.
